Presently helps institutes take attendance: students scan a QR code in class, Presently checks they’re nearby, and a P goes into the institute’s Google Sheet. These terms set out the rules for using it.

The short version

  • Institutes are responsible for the rosters they add and for how they use the attendance records.
  • Students check in only for themselves, from where they actually are.
  • Location checks can be wrong. Look at the Scan log before acting on an absence.
  • The attendance sheets live in your Google Drive and belong to you.
  • Presently is provided as it is, and can’t promise it will never be down.

Using Presently

These terms are the agreement between you and Presently. They apply when you sign in to take attendance and when you scan a code to check in. By using Presently, you accept them and the privacy policy.

If you use Presently for an institute, you confirm you’re allowed to act for it, and these terms apply to the institute too. If you don’t agree with them, don’t use Presently.

Accounts

Admins and instructors sign in with Google. Admins decide who can sign in, by being listed as admins and by adding instructors.

Keep your Google account secure. You’re responsible for what’s done with your Presently account, and you should tell us if you think someone else has used it.

Students don’t have accounts. They check in with the student ID their institute gave them.

If you run cohorts

This part is for admins, and for the institutes they act for.

  • You’re responsible for the information you add, including rosters, and for having the right to add it.
  • Tell your students that attendance is taken with Presently and that it checks their phone’s location when they check in, and point them to the privacy policy. Get any consent your rules or the law require.
  • The attendance records, and any decisions you base on them, such as grades, eligibility or warnings, are yours. Presently records attendance; it doesn’t make those decisions.
  • Keep the Google account that holds the sheets secure, and take care who you share the sheets with.

If you check in

This part is for students.

  • Check in only for yourself, with your own student ID, from where you actually are.
  • Don’t send the QR code or its link to people who aren’t in class, use someone else’s ID, or fake your phone’s location.

Your institute decides what happens if these rules are broken. Every check-in attempt, including the ones turned away, appears in its Scan log.

What nobody may do

Whoever you are, don’t:

  • try to get into accounts, cohorts or records that aren’t yours;
  • interfere with or overload Presently, or try to get round its security or its location and code checks;
  • copy, scrape or reverse-engineer Presently, except where the law allows it;
  • use Presently for anything unlawful, or to collect information about people you have no right to collect.

Presently may suspend anyone who breaks these rules.

Your data and your sheets

  • The institute owns its rosters and attendance records. Each cohort’s sheet is created in the institute’s Google Drive and stays there.
  • You let Presently store and use that information only to run the service for you, as the privacy policy describes.
  • You can edit the sheets by hand. Presently only fills empty cells with A and writes P for students who check in, so your own marks stay. If you remove the student ID column, delete a month’s tab or disconnect Drive, Presently may not be able to write attendance until it’s put back.

Location checks and their limits

Presently relies on the location a phone reports. Phones can be inaccurate, especially indoors, so a student who is in the room can occasionally be turned away. A determined student can also fake their location with special apps. Codes that change every 30 seconds and one phone per student ID make cheating much harder, not impossible.

Treat Presently’s record as strong evidence, not proof. Instructors can mark students present by hand, and the Scan log shows every attempt with its distance and accuracy. Look at it before taking serious action over attendance.

Availability and changes

Presently aims to stay up and keep improving, but can’t promise it will always be available or free of errors, or that every feature will stay. It also depends on Google: if Google’s services are down, check-ins are saved in Presently and written to the sheet once Google responds.

Presently may change or remove features. If it’s ever going to shut down, admins will get reasonable notice; the sheets are already in your Drive. If paid plans are introduced, admins will be told first, and nothing will be charged without your agreement.

Disclaimers and liability

As far as the law allows, Presently is provided “as is” and “as available”, without warranties of any kind.

As far as the law allows, Presently isn’t liable for indirect or consequential losses; for decisions made using attendance records; for changes made to sheets in Google Drive; or for problems caused by Google or other services Presently depends on. Nothing in these terms limits any liability the law doesn’t allow to be limited.

Ending

You can stop using Presently at any time. Admins can delete cohorts, remove instructors and disconnect Google Drive in Settings. To close your account entirely, contact us. Presently may suspend or end access if these terms are broken, or to protect the service and the people who use it.

Changes to these terms

When these terms change, so will the date at the top. Admins will hear about significant changes before they take effect. Using Presently after a change means you accept the new terms.

Governing law

These terms are governed by the laws of Pakistan, and disputes go to its courts, unless the law where you live gives you the right to bring them elsewhere.
